Hotel Accommodations; Two Models for Taxes ; Payments to Hotels

We facilitate your purchase of hotel accommodations but do not ourselves sell hotel accommodations nor are we a co-vendor associated with the vendors of hotel rooms booked through this Site.

Hotel accommodations marketed on our Site are offered pursuant to two different models.

Under the first model, you will pay Active the prevailing room rate available to Active at the time of reservation request, including estimated state and local room taxes and a service fee to cover Active's costs of processing and handling the payment of your room taxes (this is referred to on the Site as the "Estimated Taxes and Service Fee"). We provide an estimate of such state and local room taxes based on tax rate information that has been provided to us by the hotels or which we reasonably expect the hotels to charge. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location. Active makes reasonable efforts to ensure that the estimated tax rates charged through this Site are accurate. If you pay to Active the Estimated Taxes and Service Fee, you will have no liability to Active should additional room taxes be due in respect of your room rate beyond what you are charged upon completing your transaction for the room and room nights booked through the Site. In the unlikely event that actual tax rates are in fact lower than the estimated tax rates charged through this Site, Active will retain the difference as part of its service fee.

Under the second model, you will pay Active the prevailing room rate, excluding room taxes. When room taxes are excluded, i.e. required to be paid by you directly to the hotel rather than to Active on the Site, you will be required to pay all such applicable room taxes directly to the hotel at checkout. In this case, we will still provide to you estimated state and local room taxes based on tax rate information that has been provided to us by the hotels or which we reasonably expect the hotels to charge (this is referred to as "Estimated Taxes" on the Site). We do not include any service fee with respect to Estimated Taxes, which are not paid to Active. While Active makes reasonable efforts to ensure that the estimated tax rates are accurate, the actual state and local room taxes charged by the hotel and required to be paid by you may vary.

Please be aware that you (and/or any guests) may also incur charges at hotel(s) that are not payable to Active or included in your quoted price on the Site which nonetheless are your sole responsibility and must be paid by you directly to the hotel at the time of check-out in accordance with the hotel's prevailing policies, including, without limitation, any other governmental charges or taxes, any resort fees/service charges, charges for food and beverage, extra-person or extra-bed charges, gratuities, hotel energy surcharges, parking fees, internet, WI FI, telephone fees, room service, movies, mini-bar, transfers/transportation, and any other incidentals. For this reason, you will be required to provide a valid credit card at time of check-in to cover all such charges. All Members, authorized users and hotel guests must comply with each hotel's standard terms and conditions.

Information Collected or Received by Active

Personal Data

Personal data refers to any information about personal or factual circumstances of an identified or identifiable person. In the course of our business, we collect or receive personal information in different ways.  We may obtain the data from you or your devices.   Active may also obtain information from a third-party with whom Active has a business relationship and publicly available sources.

Retention Periods

We may retain your data for the following reasons:

Fulfilling a Contract:  When we need the data to fulfill a contract, until such time as the contractual relationship with you ceases or the legal retention periods expire,

Purposes of Use

Technical Information and Third-Party Services

When you visit our website, Active collects your IP address and other log file information (such as browser type and language, number of clicks, domain names of web sites visited, pages viewed, the amount of time spent on particular pages and the date and time of visits and page views) for statistical and maintenance purposes.

ACTIVE INTERNATIONAL's TERMS & CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING OR OBTAINING ANY CONTENT, PRODUCTS, bookings OR SERVICES from active international, including THROUGH this WEBSITE or from our reservation center.

 

1. CERTAIN DEFINITIONS
The below capitalized terms when used in these Terms shall have the respective meanings assigned below:

  • "Active" or "we" or “our” means Active Media Services, Inc. d/b/a Active International and its subsidiaries and affiliates.
  •  “Book” means to reserve on a confirmed basis, i.e. a confirmation is issued by the relevant travel provider and provided by us to the Customer.
  • "Content" means the text, documents, information, data, articles, images, photographs, graphics, software, applications, video recordings, audio recordings, sounds, designs, features, and other materials that are stored or otherwise available on the Site or otherwise available from our Reservation Center. "Content" also includes Marks and Products and Services.
  • “Club” means Active’s Employee, Friends and Family Club, membership is automatic and required with any booking made by our Reservation Center for any person or entity that is not at the time of booking either a client of Active or employee of Active, together with any additional passenger(s), family member(s), and/or guest(s) traveling with a Club member.
  • "Customer(s)" or “you” or “your” means purchaser(s) and/or traveler(s), including any client(s) or employee(s) of Active or any of its affiliates, or any member(s) of Active’s Club, together in each instance with any additional passenger(s) and/or guest(s) traveling with a Customer or Club member.  Customers may be offered the opportunity to choose a User ID and a password for this site.
  • "Mark" means trademark, trade name, service mark, trade dress, logo, custom graphics, or icon.
  • "Products and Services" means the hotel accommodations, cruises and other travel goods and services provided by Providers which available for booking through this Site or from our Reservation Center.
  • "Provider(s)" means third-party travel supplier(s), information provider(s), and travel and leisure service provider(s).
  • “Reservation Center” means the travel department of Active which makes travel reservations on behalf of Customers via phone, email or this Site. 
  • "Site" means this website, together with the respective Content, Marks, Products and Services available from this Site, as well as the software used to operate the Site.
  • "User ID" means the e-mail address you use (with your password) to login to our Site.

 

2. CONSENT TO TERMS AND CONDITIONS

Access to and use of the services of Active, including our Reservation Center and/or this Site to purchase book Products and Services is subject to acceptance of these terms and conditions ("Terms"), which includes our Privacy Policy.  By accessing, using or obtaining any content and/or purchasing and/or booking any Products and Services through this Site or from our Reservation Center and in further consideration of any cash savings your realized as a result of such usage, purchase and/or booking, you, the Customer, agree to be bound by these Terms.

PLEASE READ THE TERMS BEFORE USING THIS WEBSITE OR OUR RESERVATION CENTER.  These Terms govern the relationship between Active and you, the Customer and, among other things, include terms that restrict your rights and remedies and provide protection to Active, and also include warranty disclaimers and liability exclusions.   IF THERE IS ANY PART OF THESE TERMS YOU, THE CUSTOMER, DO NOT AGREE WITH, PLEASE DO NOT USE THIS SITE OR ACTIVE’S RESERVATION CENTER. No alterations to these terms and conditions may be made by our Reservation Center. 

 

3. TRAVEL DOCUMENTS AND IDENTIFICATION REQUIREMENTS

 

It is the responsibility of each Customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records.  Active strongly recommends that you take into account that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry . Non-United States citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/s/global-search/consent forms for minors for forms. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Customer to miss flight(s), and subsequent scheduled travel bookings on cruises and tours. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required.

When you receive any and all travel documents, it is the sole responsibility of the Customer to review and verify all information. Contact Active immediately if changes or corrections are required with respect to any travel documents provided by Active.
 

4. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries.  If you have a current or past offense or felony conviction, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (Check the Entry, Exit and Visa Requirements for the country you are entering at https://travel.state.gov/content/travel/en/international-travel.html)   We feel it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Mexico, Mexican law permits Mexican immigration authorities to deny entry to Americans into Mexico if they have been charged with or convicted of a serious crime in Mexico or elsewhere (see details at https://travel.state.gov/content/travel/en/international-travel/International-Travel-Country-Information-Pages/Mexico.html), as an additional example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers.(Reference http://www.cic.gc.ca/english/information/faq/inadmissibility/index.asp)
 

5. RISKS/SAFETY

Travel to certain destinations may involve greater risk than others. Active urges Customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at  https://travel.state.gov/content/travel/en/international-travel.html and http://www.cbp.gov . The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, ACTIVE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CUSTOMER’S OWN RISK.

 

6. USE OF THIS SITE AND INFORMATION PROVIDED; AGE LIMITATIONS

You warrant that you are at least 18 years of age and possess the legal authority to make travel bookings to purchase Product and Services with Active by any means, including this Site or our Reservation Center in accordance with all Terms herein. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you).  Minors (as defined under the laws of their jurisdiction or residence) are not eligible to register for, access or use this Site, or Book any Products and Services available on the Site. The Site is not intended for children.  You agree to keep any minors listed under your name or account off of this Site.  If you are under 13 you should not access this Site or provide to us any identifying information about yourself.  You also warrant that all information supplied by you or members of your household transacting business with Active is true and accurate. You are responsible for maintaining the secrecy of your User ID and password for this Site. In addition, you will be financially accountable for all use of our Site by you and anyone using your password and login information.    

 

7. ADDITIONAL TERMS, CONDITIONS AND REQUIREMENTS OF PROVIDERS

You understand and agree that Products and Services are provided subject to the terms, conditions and requirements of each Provider you select (and as identified on your confirmation). You agree to abide by the terms, conditions and requirements of each Provider as well as these Terms. As example, Providers of hotels accommodations have terms, conditions and requirements regarding, among other things, (i) cancellation and “late check-out”; (ii) presentation at check-in of a valid credit card and picture identification; (iii) check-out by the times indicated by the Provider, and (iv) payment of any amounts due the Provider at time of check-out.  Additionally, due to Covid -19 Providers, e.g. hotels, airlines, rental car companies, etc., may also have issued additional requirements such as, among others, mask wearing, temperature or Covid testing, and social distancing.   You are responsible for checking the terms, conditions and requirements of each Provider that pertain to your travel, and we strongly recommend that prior to traveling you check the Covid-19 related requirements issued by your Provider, as well as your state of residency, destination state or country. 

 

8. TRAVEL INSURANCE

 

Active highly recommends that Customer(s) purchase appropriate travel insurance from a third party provider which includes coverage for medical treatment and, due to Covid-19, medical evacuation that does not exclude airborne pathogens.

TRAVEL INSURANCE IS RECOMMENDED TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. Without appropriate travel insurance, Customer understands and agrees that if Customer cancels or interrupts Customer’s travel for any reason, portions of the trip may not be refunded and Providers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Customer’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any Products and Services offered by Active.  Active does not sell Travel Insurance and employees of Active are not qualified or authorized to: answer technical questions about benefits, exclusions, and conditions of any Travel Insurance, or evaluate the adequacy of any Customer’s prospective or  existing Travel Insurance coverage.

 

9. AIR, CHECK-IN, SCHEDULE RECONFIRMATION

ACTIVE DOES NOT BOOK AIRLINE RESERVATIONS ON BEHALF OF CUSTOMERS.  It is each Customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. Active shall not assume any responsibility for any air travel or ground transfers.  Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights.  Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.  Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.

 

10. HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS

Each Customer is responsible to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities.  Active shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice.  Prior to travel, required inoculations, if any, must be recorded by Customer’s health practitioner on a valid vaccination certificate, which the Customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking.  Check the USA State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues. When travelling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification found http://www.tsa.gov/traveler-information/acceptable-ids. Examples: DHS-designated enhanced driver’s license, USA Passport, a foreign government passport.


11. HAZARDOUS MATERIALS

USA federal law prohibits passengers from bringing hazardous materials on the aircraft. (1) USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. (2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. 12. INSECTICIDE NOTICE

All passengers are referred to always check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the DOT’s website, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

 

13. CERTAIN ADDITIONAL RESTRICTIONS FOR CLUB MEMBERS

The Products and Services and any special offers or savings associated with such Products and Services offered through this Site are exclusively for the use and benefit of our Customers and are not available to the general public. Membership in Active’s Club is at the sole discretion of Active, and is limited to client(s) and prospects of Active, employees of Active and its client(s), and may be extended to include, at the discretion of Active, their respective family and/or friends (or such family and/or friends may be allowed, as authorized users, to utilize the Product and Services acquired by a Customer).  Employees of Active, its affiliates or subsidiaries who are Customers will, at all times, remain responsible for ensuring that any of their friends and family members who are authorized users of Products and Services comply with these Terms and/or any additional terms and conditions applicable to such Products and Services.Club members are subject to additional restrictions and requirements as follows:  (i) to keep any savings realized by booking with the Club confidential as  discussing  savings and/or benefits acquired through the Club with any third parties, including, without limitation, travel agents, other guests/travelers or Providers, in each instance will damage our relationships with our Providers and will result in immediate membership termination; (ii) to not (or attempt to) resell/auction/transfer any Products and Services, including, without limitation on VRBO, Airbnb, SkyAuction, or EBAY; (iii) to only use Product and Services for personal, leisure use – no business travel is allowed; (iv) all reservation requests are subject to general availability at the time of receipt and certain other restrictions may apply, including blackouts (travel offers are subject to change and/or termination by Active at any time without notice): (v) all Product and Services are made available by Active strictly in its sole discretion, quantities are limited and provided on a strictly first come/ first serve basis, and Active may change, withdraw or terminate any offering(s) at any time; (vi) no travel purchased from Active may replace any pending reservation(s) or existing booking(s) any Club members may have with the same travel provider (even if cancelled by the Club member), i.e. you cannot cancel and rebook through Active to acquire savings; (vii) all reservation requests must be made directly and exclusively with Active’s Reservation Center M-F 8:30 am to 5:30 pm excluding all major holidays at 1-800-852-8864 or reservations@activeinternational.com (please do not contact any Provider(s) directly).

 

14. PRIVACY POLICY

At all times your information will be treated in accordance with Active’s Privacy Policy which is incorporated herein and can be viewed at https://www.activeinternational.com/privacy-policy. You agree that you have read our Privacy Policy, and it is reasonable and acceptable to you. 

 

15. SERVICES AND CONTENT

Availability
We will use our reasonable commercial efforts to keep our Site available on a 24-hour/7-day-a- week basis, subject to necessary scheduled downtime for maintenance, unscheduled maintenance, and system outages. We cannot promise that access to the Site will be uninterrupted or available at all times. We assume no liability or responsibility for any delay, interruption, or downtime.   Our Reservation Center is open M-F 8:30 am to 5:30 pm excluding all major holidays and may be contacted at 1-800-852-8864 or reservations@activeinternational.com

The Content is intended for information purposes only. Although we exercise reasonable efforts to ensure their quality and accuracy, there might be errors, or the information provided may not be complete, current, or applicable to your particular situation. Further, information provided regarding the service, amenities, products, etc. have been provided to us by the vendor. We assume no liability or responsibility for any errors or omissions. You are responsible for evaluating the accuracy, completeness, and usefulness of any opinion, advice, or other content available through the Site.

You should not take any action based on information on this Site until you have received a confirmation of your Booking request. We send confirmations within 24 hours of your Booking; provided however, if you send a Booking request on a Saturday or Sunday, we send confirmations on the following Monday. If you have not received a confirmation of your Booking via e-mail, first look into your "spam" or "junk" folder to verify that it has not been misdirected, and if still not found, please contact our travel department. Viruses
We make reasonable attempts to exclude viruses from the Site, but cannot ensure that the Site will be at all times free from viruses or other destructive software. You are urged to take appropriate safeguards before downloading information from the Site. We assume no responsibility for any damages to computer equipment or other property that may result from use of the Site or downloading anything from the Site.

 

16. HOTEL ACCOMMODATIONS AND TAXES – TWO MODELS

Hotel accommodations marketed on our Site are offered pursuant to two different models.  Under the first model, you will pay Active the prevailing room rate available to Active, including room taxes.  Under the second model, you will pay Active the prevailing room rate, excluding room taxes.  When room taxes are excluded, you will be required to pay all such applicable room taxes directly to the hotel at checkout.

Active makes no representation(s) or warranty(ies) of any kind or nature, including, without limiting the generality of the foregoing, regarding this Site, any Provider(s) or any Products and Services, all of which are provided on an "as is" basis. ACTIVE EXPRESSLY DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES OF EVERY KIND AND NATURE, INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, MERCHANTABILITY, FITNESS FOR A PARTICULAR, SUITABILITY OF ANY PROVIDER(S), PRODUCTS AND SERVICES, OR TRAVEL DESTINATIONS, THE USE OF THIS SITE, INCLUDING THAT THIS SITE OR ITS CONTENT WILL BE FREE FROM ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT COMMUNICATIONS TO OR FROM THIS SITE WILL BE SECURE AND NOT INTERCEPTED.

The fact that Active is including or offering any Products and Services on the Site or through its Reservation Center is not an endorsement or a recommendation of any Provider(s) or Products and Services. 

 

18. LIMITATIONS OF LIABILITY, DISCLAIMERS AND RELEASE

When booking Products and Services on this Site or through Active’s Reservation Center, Active is acting solely as a booking agent for each Provider (each of which is a disclosed principal), and Active is not the source or provider of the Products and Services. Each Provider is an independent entity with its own management, and is not subject to the control of Active.Customer is advised that Providers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those Providers, and understands and agrees that Customer is subject to each Provider’s terms and conditions which may be found on their respective Web sites or other travel documentation issued by Providers, and which govern each Provider’s Products and Services (including any booking made on your behalf by Active). All bookings are accepted by Active (either on this Site or through its Reservation Center) solely as agent for the relevant Providers on your travel confirmation or other documentation.All Products and Services provided by the identified Providers are subject to the respective Provider’s terms and conditions contained in any tickets, exchange orders or vouchers issued by them and/or their suppliers, including the terms and conditions on their respective Web sites.


EACH CUSTOMER (INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ANY GUEST(S) OR OTHER TRAVELER(S) ACCOMPANYING ANY CUSTOMERS) AGREES THAT ACTIVE IS NOT RESPONSIBLE OR LIABLE IN ANY WAY WHATSOEVER FOR ANY CLAIMS, LIABILITY, ACTIONS, CAUSES OF ACTION, AND/OR DAMAGES OF WHATSOEVER KIND OR NATURE (COLLECTIVELY “DAMAGES”), WHETHER FOR PERSONAL INJURY, PROPERTY LOSS, DEATH OR OTHER DAMAGES) ARISING OUT OF OR RELATED TO ANY ACT(S), OMISSION(S), NEGLIGENCE, REPRESENTATION (OR MISREPRESENTATION), BREACH, OR WARRANTY OF OR BY ANY PROVIDER(S) OR OTHER THIRD PARTY, E.G. ANY HOTEL(S), RESORT(S), CRUISE LINE(S), AIRLINE(S), RENTAL CAR COMPANY(IES), ETCETERA, INCLUDING WITHOUT LIMITATION, BY REASON OF ANY OVERBOOKING, DELAYS, CANCELATIONS, MISSTATEMENTS, STRIKE, FORCE MAJEURE EVENT (E.G. HURRICANE, FLOOD, PANDEMIC, ETC.) OR ERRORS IN THE PROVIDERS’ BROCHURES OR WEBSITE AND HEREBY EXPLICITLY RELEASE, DISCHARGES AND AGREES TO HOLD HARMLESS, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACTIVE AND ITS SHAREHOLDERS, EMPLOYEES, AGENTS AND ASSIGNS, ONE AND ALL, FROM ALL SUCH DAMAGES, INCLUDING ALL “COSTS”.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, IN NO EVENT WILL ACTIVE BE LIABLE TO ANY CUSTOMER(S) OR ANY OTHER PARTY(IES) (INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ANY GUEST(S) OR OTHER TRAVELER(S) ACCOMPANYING ANY CUSTOMER(S)), FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY (I.E. WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH: (I) ANY CONFIRMATION(S) AND/OR BOOKINGS OF PRODUCTS AND SERVICES ISSUED AND/OR MADE THROUGH THIS SITE OR ACTIVE’S RESERVATIONS CENTER; (II) ANY PRODUCTS AND SERVICES PROVIDED BY ANY PROVIDER(S) AND/OR ANY ACT(S), ERROR(S), OMISSION(S), NEGLIGENCE, MALFEASEANCE OR OTHER ACTION(S) OR ACTIVITIES OF ANY PROVIDER(S), OR OF ANY PROVIDERS’ EMPLOYEES OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ANY  MISREPRESENTATION, BREACH, INJURY, LOSS, ACCIDENT, DELAY, OVERBOOKING, CANCELLATION, FAILURE OR OTHER DELAY IN PROVIDING PRODUCTS AND SERVICES, OR INADEQUATE DELIVERY OF ANY PRODUCTS AND SERVICES; (III) ANY USE OR INABILITY TO USE ANY PRODUCTS AND SERVICES; (IV) ANY USE OF THIS SITE; AND (V) ANY OTHER MATTERS OUTSIDE OF ACTIVE’S CONTROL, REGARDLESS IN EACH INSTANCE OF WHETHER ACTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

NO ACTION, REGARDLESS OF FORM, ARISING FROM OR PERTAINING TO or arising in connection with any BOOKING MAY BE BROUGHT BY you morE THAN six MONTHs AFTER the earlier of THE DATE OF SALE the products and services, completion of travel, and the date that SUCH ACTION HAS ACCRUED.

If, despite the foregoing limitation of liability, Active is found liable by a court of competent jurisdiction for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then Active's liability will in no event exceed, in total, the sum of the cash amount actually paid by a Customer to Active as the purchase price for the Products and Services purchased from Active.


19. INDEMNIFICATION

You agree to defend and indemnify Active and its officers, directors, employees and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, in excess of the liability described above, in any action filed or commenced by any third party against Active as a result of (i) your breach of these Terms, or (ii) your violation of any law or the rights of a third party.

 

20. DISPUTES; ARBITRATION

All Customers irrevocably agree that binding arbitration in New York, New York before one (1) arbitrator shall be the exclusive method (rather than a civil trial, with or without a jury) to resolve any dispute, claim or controversy arising between Active and any Customer, including, without limiting the generality of the foregoing, under these Terms, and/or any Booking of Products and Services made on this Site or through Active’s Reservation Center, or any breach, termination, enforcement, interpretation or validity thereof.  In addition to all other matters, the arbitrator shall have exclusive authority to determine any and all issues and matters relating to the scope of the arbitration, the arbitrability of any claim or dispute, the validity of the agreement to arbitrate, and the arbitrator’s jurisdiction.  The arbitration and the selection of the arbitrator shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, including the Recommended Arbitration Discovery Protocols for Domestic Commercial Cases as set forth in Rules 16.1 and 16.2, as amended.  The arbitrator shall have authority to hold hearings at any location or in any jurisdiction in aid of obtaining information and testimony from third parties.  Judgment on the award or any interim award may be entered in any court having jurisdiction.  In any arbitration hereunder, the arbitrator shall award to the prevailing party, if any, the reasonable attorneys’ fees and costs reasonably incurred by the prevailing party in connection with the arbitration.  If the arbitrator determines that a party prevails on some, but not all, of the claims and counterclaims, the arbitrator may award the prevailing party an appropriate percentage of the costs and attorneys’ fees reasonably incurred by the prevailing party in connection with the arbitration.  The arbitrator selected shall be a former judge or an attorney with experience as a partner of a major law firm and have at least ten (10) years’ experience with business matters, business relationships and related financial matters.  This clause shall not preclude parties from seeking provisional remedies from any court of competent jurisdiction in jurisdiction as may be necessary to preserve the status quo and in aid of arbitration.   This arbitration provision shall be governed and interpreted solely in accordance with the Federal Arbitration Act, 9 U.S.C. §§1 et seq. 

 

21. INTELLECTUAL PROPERTY RIGHTS

Ownership Rights
This Site (including the programming for the Site) and its Content is the sole and exclusive property of Active or its licensors. Active and its licensors retain all right, title and interest (including all copyright, trademark, patent, trade secrets, and all other intellectual property rights) in the Site and its Content. The Site is protected by copyright, trademark, patent, trade secrets, unfair competition, and other laws of worldwide, through the application of local laws or international treaties.  Any unauthorized use, reproduction or modification of this Site may violate such laws.

Your Comments and Submissions
Any communications or materials you transmit to Active, through the Site, by electronic mail or otherwise, including any data, question, comments, rating of a property or attraction, suggestion, idea, or the like ("Communications or Materials") will be treated as non-confidential and non-proprietary. By voluntarily submitting to us, or by posting on the Site any Communications or Materials, you grant Active, and all users of the Site, a worldwide, non-exclusive, royalty free, perpetual, irrevocable, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from distribute, and display such Communications or Materials in any form, media or technology. We assume no responsibility for any Communications or Materials posted or submitted, or for the return or such Communications or Materials. We want your feedback and appreciate your ideas and suggestions, but we are unable to answer every comment individually. Active grants you a limited, personal, nontransferable, non-sublicensable, revocable license to access and use the Site only as expressly permitted in these Terms. Except for this limited license, we do not grant you any other rights or license with respect to this Site; any rights or license not expressly granted herein are reserved.  Unless we have granted you permission in advance and in writing, you may use the Site only for your personal, non-commercial use, and not to provide services to a third party.


No Copy, Distribution, or Sale
You may download, display, or print one (1) copy of any portion of the Content.  If you do so, you may not modify the Content in any way.

Except as provided above, you may not:

  1. Copy, reproduce, upload, post, display, republish, distribute, transmit, any part of the Content in any form whatsoever;

  3. Use the Site to make any false, fraudulent or speculative reservation, or any reservation in anticipation of demand;
  4. Use or access the Site in any way that, in our reasonable judgment, adversely affects the performance or function of the Site, or any other computer systems or networks used by Active, other Site users or Customers;
  5. Upload or transmit to the Site or use any device, software or routine that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that may damage, interfere or attempt to interfere with, intercept, the normal operation of our Site, or appropriate the Site or any system, or take any action that imposes an unreasonable load on our computer equipment, or that infringes upon the rights of a third party;
  6. Use any device, software, or routine that interferes, or attempts to interfere, with the normal operation of our site, or take any action that impose an unreasonable load on our equipment; or
  7. Disguise the origin of the information transmitted through the Site.

Password
Access to certain areas of the Site is only available to registered Customers.  If you believe your password has been stolen or is otherwise being used without your authorization, please immediately notify Active and change your password by logging in to the Site and clicking “change password” under the “My Account” link located on the main menu.


Termination
Active, in its sole discretion, may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of our Site, even if access continues to be allowed to others. Upon such termination or suspension, you must immediately discontinue use of the Site, and destroy any copy you have made of any portion of the Site. Accessing the Site after such termination, suspension, or discontinuation shall constitute an act of trespass. 

 

22. COPYRIGHT POLICY 

You may not use the Site or any Products and Services to post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary materials belonging to others without obtaining the prior written consent of the owner of such proprietary materials.  It is Active’s policy to terminate privileges of any Customer or other user of the Site who infringes the copyright of others upon receipt of prompt notification to Active by the copyright owner or the copyright owner's legal agent.  Without limiting the foregoing, if you believe that your work has been copied and posted on the Site in a way that constitutes copyright infringement, please review and utilize our procedures for protecting your rights as set forth below. 


In accordance with the Digital Millennium Copyright Act, 17 U.S.C. 512, Active has adopted the following policy concerning copyright infringement.  Active respects the legitimate rights of copyright owners and their agents and representatives.  Customers and others who use any part of the Site are required by these Terms to respect the legal protections provided by applicable copyright law.


Procedure for Reporting Copyright Infringements.  If you believe that your work has been copied on this Site in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide us with the following information:

  • A description of the copyrighted work or other intellectual property that you claim has been infringed;
  • A description of where the material that you claim is infringing is located on the Site (including the specific URL of each item in dispute, which should help us to quickly locate the Content);
  • Your address, telephone number, and email address;

If Active receives proper notification of claimed copyright infringement, it will respond expeditiously by removing, or disabling access to, the material that is claimed to be infringing, as described below, or to be the subject of infringing activity.  Active will also comply with the appropriate provisions of the DMCA in the event a counter-notification is received, as described below.  Active may, at its discretion, deny access to this Site by, or disable and/or terminate the accounts of, Customers or other users who may be infringers.

If Content you posted on the Site was removed for copyright or intellectual property infringement and you would like to dispute that removal, the process for counter-notifications is governed by Section 512(g) of the Digital Millennium Copyright Act:
 

  • To file a counter-notification with us, you must provide a written communication that sets forth the items specified below.

  • Identify the specific URLs of material that Active has removed or to which Active has disabled access.
  • Provide your full name, address, telephone number, email address and the Customer name of your Active account.
  • Provide a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or New York County, New York; if your address is outside of the U.S.A.), and that you will accept service of process from the person who provided notification to Active in accordance with the process outlined above or an agent of such person.
  • Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Sign the notice.  If you are providing notice by email, a scanned physical signature or a valid electronic signature will be accepted.  Send the communication to the following address:

After we receive your counter-notification, we will forward it to the party who submitted the original claim of copyright infringement.  Please note that when we forward the counter-notification, it includes any of your Identifying Information set forth in the counter-notification.  By submitting a counter-notification, you consent to having such Identifying Information revealed in this way.  We will not forward the counter-notification to any party other than the original claimant.

After we send out the counter-notification, the claimant must then notify us within ten (10) days that he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on the Site.  If we receive such notification, we will be unable to restore the items.  If we do not receive such notification, we may, but are not obligated to, reinstate the disputed item(s).

  • Your acceptance of these Terms and your use of the Site do not create a joint venture, partnership, employment, or agency relationship with us. You may not assign, delegate, or transfer your rights or obligations under these Terms. If we fail to act with respect to your breach or anyone else's breach on any occasion, we are not waiving our right to act with respect to future or similar breaches. If a court finds any of these Terms to be unenforceable or invalid, such Term will be enforced to the fullest extent permitted by applicable law and the other Terms will remain valid and enforceable. The headings in these Terms are for your convenience and reference; they do not limit or affect these Terms. These Terms, together with those items made a part of these terms by reference, make up the entire agreement between us relating to your use of our site, and replaces any prior understandings or agreements (whether oral or written) regarding your use of our site.
     
  • The laws of the New York, without regard to its conflict of law rules, will govern these Terms and any Bookings made by Customers on this Site or through Active’s Reservation Center.  
     
  • If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
     
  • These Terms (and any other terms and conditions referenced herein) constitute the entire agreement between the Customer and Active with respect to travel bookings made on this Site or Active’s Reservation Center, and  supersede all prior or contemporaneous communications and proposals as well as Terms displayed on this Site prior to the date first set forth above, whether electronic, oral, or written, between Customer and Active.
     
  • Active reserves the right, in its sole discretion, to update or modify these Terms, impose new conditions, or make any other additions, deletions, modifications or changes to any part of the Site at any time without prior notice. Such changes, modifications, additions or deletions will be effective immediately upon posting on the Site. Your use of the Site following any such changes constitutes your agreement to follow and be bound by the revised Terms. For this reason, we encourage you to review these Terms, before you use this Site, to see if these Terms changed.
     
  • “Force Majeure” means, in relation to Active, any circumstances beyond the reasonable control of Active, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, pandemic/epidemic, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). Active shall not be deemed to be in breach of these Terms or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
     
  • You may preserve these Terms in written form by printing them for your records, and you waive any other requirement that these Terms be evidenced by a written document. 
     
  • To the extent that we may need to contact you, you agree that we may do so via any electronic means, included but not limited to communication posted on the Site, email, or instant messaging.

Who is Active?
As used on this travel website, Active refers to the travel department of Active Media Services, Inc. d/b/a Active International. Active's travel department has over 25 years of travel experience and a fully staffed reservation and meetings department.

Active is a corporate trading company. Corporate trading is the name used to describe business transaction in which Active enters into trading, like kind exchanges, cross purchase transactions and other similar business transactions, including issuing and/or accepting trade credits, to provide customized business solutions to its clients. Such transactions may include the issuance of Trade Credit by Active which is usable by the holder in connection with the purchase of goods and services reasonably available to Active as a trading company subject to the terms of the trading agreement between Active and such holder.

Can I make a reservation online?
Yes. You can search for your destination and make your reservation on this website. Please note, however, so that we may provide the highest level of customer care, certain hotels and cruise lines may only be booked with one of our travel specialists. In such case, you can submit a booking request to one of our travel specialist who will contact you promptly to review and assist you with your request. Meetings can not be booked on line, but you can requested a meeting on line by clicking the icon “Request a Meeting” and one of our meeting specialists will contact you promptly to discuss your meeting needs

How will I know my reservation is confirmed?
After you have finalized and paid for your booking on the website, you will reach a “Confirmation Page” which will list your confirmed booking. At this time you may print your confirmation and a confirmation will also be sent to you by email to the e-mail address you provided when you signed up for the website. Please provide your confirmation number at check-in and have your confirmation available if needed. When you receive your confirmation, please be sure to review it carefully. I don't see my hotel? Why doesn't Active Travel offer all hotel properties?
While Active is staffed with experienced travel professionals, it is not a travel agency. Active is a corporate trading company, which acquires its travel inventories by entering into trading transactions with travel providers. This is the reason why we are able to accept Trade Credit usage as partial payment for travel purchased on this website. Why are cruises and some hotels only available on-request?
So that we may provide the highest level of customer care, cruise lines and certain hotel properties require Active to fulfill travel requests in person and to make bookings through a designated cruise or hotel contact.

What if I need to cancel or make changes to my itinerary?
If you wish to cancel your booking, you must comply with the Hotel's applicable cancellation policies, which are subject to change by Hotel at any time. While we make reasonable efforts to provide you with the Hotel's cancellation policy, since the Hotel may change its policies at any time, you are responsible for verifying with the Hotel its current cancellation policy. Please note that your booking may be non-cancelable by reason of the Hotel's cancellation policy or the terms of any promotion offered by Active on the website. You may contact Active's travel department with your cancellation request, however we require at least 3 business days prior notice from any required hotel cancellation date. If you can not provide us with sufficient notice, or you need to cancel immediately to comply with the hotel's policy and avoid penalties, you must contact the Hotel directly to cancel your booking and receive a valid Hotel cancellation number. You must provide this cancellation number to us promptly or you will continue to be charged in full by us for your booking. If we receive a valid hotel cancellation number, subject to any cancellation penalty required to be paid by you, we will promptly adjust any payments paid or payable by you to us.
If you want to modify your booking, you must contact one of our reservation specialists who will be happy to assist you with your request. No cancellation or modification of your reservation can be made on-line.

If you are enrolled in a Hotel's loyalty or rewards program, most Hotel's will provide you with loyalty or reward points for hotel purchasers made through Active Travel's website provided that you provide at the time of check in your membership information and request your award of loyalty or reward points for your stay.

Where does the hotel room rate come from?
The hotel rates that you see on this website are prevailing rates available to Active at the time of reservation request from the various hotel's websites and are provided on this website by SABRE, our global distribution system. The prevailing rates generally exclude any membership or affiliation rates, such as AAA, or military rates, AARP, which rates are not available to Active or on this website as well as other special rates that may not be available to Active. Your Trade Credit usage is applied against the prevailing rates provided on this website.

PAYMENT QUESTIONS

What is a Trade Credit?
A Trade Credit is a non-monetary credit issued by Active that may be usable to pay partially or all of the costs payable to Active on this website for travel. It is not redeemable for cash. The amount of Trade Credit usable by the holder is determined by your company's trade agreement with Active. The website automatically calculates the amount of Trade Credit available for your use. In addition, at the discretion of Active, Active may offer Promotions to increase the percentage of Trade Credit usage. Please refer to your trade agreement for specific terms and conditions of usage for Trade Credit.

How do I know my Trade Credit Balance?
Your company's balance of Trade Credits is available through your company's travel administrator.

What if I don't have enough Trade Credits to complete the purchase?
You will not be able to complete a purchase if you do not have sufficient Trade Credits. Instead, you will be provided the opportunity to send a request to Active Travel and a travel specialist will verify the Trade Credit available and offer to complete your travel request if there is sufficient Trade Credit. We will also notify your travel administrator of any Trade Credit deficiencies.

How Much Trade Credit Can Be Used?
The amount of Trade Credit usable to pay (partially and/or in full) for travel on the website is determined by the terms of your trade agreement with Active. For corporate clients, Trade Credit usage is generally usable to pay for up to 25% of the payments payable to Active on this website. On the website's landing page Active may provide, from time to time, and in its sole discretion, “Promotions” which may be used to increase Trade Credit usage. For our media vendors and other suppliers that hold Trade Credit, the terms of your trade agreements with Active generally provide usage of Trade Credit at an agreed upon ratio to purchase and pay for travel. In all instances, when a user logs on to the website, the terms of your trade agreement with Active are retrieved from our data system and Trade Credit usage is made available pursuant to the terms of your trade agreement.

How do I calculate Trade Credit Usage?
If your travel product is purchasable on this website, at any time prior to purchasing your travel product, you can click on the “See Trade Credit Usage” icon which will automatically determine the amount of Trade Credit usable by you in connection with your purchase If a Promotion is available, you may be able to get additional Trade Credit usage. Simply insert the Promotion code in the box provided at the time of checkout, and any additional Trade Credit usage will be automatically calculated. If the travel product is only available on request, such as a meeting, certain hotels/resorts, cruises, after you submit your on line request, when our travel specialist contacts you, she will discuss with you the percentage of Trade Credit usage available for the applicable travel product requested.

When do you charge my credit card for a travel reservation?
Unless other arrangements have been made with Active, at time of purchase you will be required to provide your credit card information to complete your purchase, which will be processed at the earlier of (i) your time of travel, or (ii) 30 days from your purchase on this website.

What is a Promotion and a Promotion code?
From time to time Active Travel may make available to Trade Credit holders certain specials at designated properties, including, but not limited, for our vendors paying entirely in Trade Credit, better ratios for Trade Credit usage, and/or for our corporate clients paying in cash and Trade Credit, additional Trade Credit usage. Some promotions may require booking with a travel specialist to receive the promotion benefit. When a promotion code is provided for a promotion you can insert it in the promotion code box at time of check out to get the promotion benefit. Please remember to check for the promotions on our landing page which can be accessed at any time by clicking on “Home” on the top toolbar as we change them often. How do I get more Trade Credits?
For our corporate clients, Trade Credits are issued by Active to your company pursuant to a corporate trading transaction. Your company can acquire additional Trade Credit by entering into an addendum with Active to its existing corporate trading agreement. Please contact Active for further information and we will be happy to assist you.

What am I required to pay to the hotel?
Hotel accommodations marketed on our website are offered pursuant to two different models. Under the first model, you will pay Active the prevailing room rate available to Active at the time of reservation request, including estimated state and local room taxes and a service fee to cover Active's costs of processing and handling the payment of your room taxes (this is referred to on the website as the “Estimated Taxes and Service Fee”). We provide an estimate of such state and local room taxes based on tax rate information that has been provided to us by the hotels or which we reasonably expect the hotels to charge. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location. Active makes reasonable efforts to ensure that the estimated tax rates charged through this website are accurate. If you pay to Active the Estimated Taxes and Service Fee, you will have no liability to Active should additional room taxes be due in respect of your room rate beyond what you are charged upon completing your transaction for the room and room nights booked through the website. In the unlikely event that actual tax rates are in fact lower than the estimated tax rates charged through this website, Active will retain the difference as part of its service fee.
Under the second model, you will pay Active the prevailing room rate, excluding room taxes. When room taxes are excluded, i.e. required to be paid by you directly to the hotel rather than to Active on the website, you will be required to pay all such applicable room taxes directly to the hotel at checkout. In this case, we will still provide to you estimated state and local room taxes based on tax rate information that has been provided to us by the hotels or which we reasonably expect the hotels to charge (this is referred to as “Estimated Taxes” on the website”). We do not include any service fee with respect to Estimated Taxes, which are not paid to Active. While Active makes reasonable efforts to ensure that the estimated tax rates are accurate, the actual state and local room taxes charged by the hotel and required to be paid by you may vary.
Please be aware that you (and/or any guests) may also incur charges at hotel(s) that are not payable to Active or included in your quoted price on the website which nonetheless are your sole responsibility and must be paid by you directly to the hotel at the time of check-out in accordance with the hotel's prevailing policies(s), including, without limitation, any other governmental charges or taxes, any resort fees/service charges, charges for food and beverage, extra-person or extra-bed charges, gratuities, hotel energy surcharges, parking fees, internet, wi fi, telephone fees, room service, movies, mini-bar, transfers/transportation, and any other incidentals, all of are required to be paid by you directly to the hotel at time of check out in accordance with each hotel's prevailing policies. For this reason, you will be required to provide the Hotel with a valid credit card at time of check-in.

How can I be sure my credit card information is secure?
Our server uses Secure Sockets Layer (SSL) technology to create an encrypted connection between itself and your browser. In this process, your browser identifies itself as capable of handling this type of transaction and both the browser and the server verify each other's credentials with a third-party agency that confirms that both sides of the conversation really are who they say they are. This is the same type of technique your bank uses to transfer millions of dollars between itself and other banks every day. Furthermore, we don't' store any credit card information, we simply pass all information to Paypal which acts as our payment gateway and takes care of all credit card processing.

MEETINGS AND EVENT PLANNERS

My company uses an outside Travel Agent. Can I still book a meeting through Active?
Yes. There is no service fee or commission to utilize our travel products. We work with your existing in-house travel department and outside travel agents. We offer a value added service to our clients which is easy to use and provides savings through Trade Credit usage or trading.

How will I know if I got the best rates and concessions for my meeting?
After we approve your meeting towards the program, either your internal travel team or your travel agent will negotiate the rates and concessions directly with the hotels. This way you will know you are receiving the best rates. We also encourage you to follow your standard process, which may include submitting your group RFP to multiple properties to get comparable rates.

Who oversees and maintains control of my meeting?
You or your travel agent will be in control of your meeting. Once Active has cleared and approved you as its client with the hotel, and verified that it has sufficient inventory for your meeting (this takes approximately 1 business day), we will introduce you or your travel agent directly to the hotel. You may then negotiate your meeting and group contract as you would normally do.

How do I request a meeting?
You can request a meeting directly on our Site. Your request will be received by one of our meeting planners who will promptly contact you. You may also call us during normal business hours M-F 8:30am – 5:30pm at 1-800-852-8864

Can I speak directly to the hotel?
Yes, we only ask that you do not contact the hotel prior to our establishing you as our client. Please understand, the hotel is also our client and has its own sales team. If you are an existing client or existing prospect with a hotel of ours (other than through our introduction), we generally can not provide the benefits of Trade Credit usage or trading for your meetings.

Why don't you have every hotel?
We are a unique travel provider in that our hotels are also our trading partners. Consequently, our travel portfolio only includes hotels that have entered into trading agreements with us so that we can provide savings to you through Trade Credit usage or trading. We are constantly negotiating or renewing our agreements with hotel ownership groups, hotel brands and individual hotels so our hotel Portfolio is constantly growing and changing.

Do I have to pay Active any commission or fees for meeting services?
No, there is no commission or fee payable to us for our services.

Can I get a commissionable rate for my meeting?
All rates with our hotels are non-commissionable. If your travel agency normally remits its commission to you as part or your arrangement, we can assure you that your Trade Credit usage will generally be in excess of any such commission usually received for sleeping rooms. Unlike a commission, Trade Credit usage may also be available for the entire cost of your meeting.

How is the process changed if I book a meeting with Active?
We have a simple process which varies very little from your normal process. To start, you pick the hotels you want to use from our Portfolio. We then clear you as our client with the hotels and verify inventory availability for your usage (this takes approximately 1 day). Then we introduce you to the hotels to negotiate your rates and group agreements as you normally would. Prior to executing your group agreement, we will mutually agree upon how best to implement Trade Credit usage. Generally, Active will act as your payment agent so that you will pay Active in cash and Trade Credit and Active, in turn, will pay the hotel. This will require you to add a short provision in your hotel agreement to such effect.

How much Trade Credit can I use for my meeting?
The amount can vary, but we generally offer 25% Trade Credit usage on sleeping room rates, and in some instances can extend 25% Trade Credit usage to banquet food and beverage, meeting space costs, and in some instances, the entire cost of the meeting, i.e. all charges posted to the master account. It depends upon our agreement with the hotel. We will advise you at the time you choose the hotel of the available Trade Credit usages. From time to time we also offer specials for greater Trade Credit usage for featured hotels

We suggest that you provide us with as much information regarding your meeting needs as possible so that we can identify and match hotels from our Portfolio to meeting you needs. What is a Corporate Administrator?
A Corporate Administrator has been chosen by your company to have administrative rights over your account in the Active Travel website. The Corporate Administrator has the ability to create, enable and disable accounts, run usage reports, set user limits and create another Corporate Administrator.

Can I control who has access to your website?
The Corporate Administrator can limit use of the website to administrative use, or you can provide access to selected employees.

How do I add a Corporate User?
The Corporate Administrator can add users in the Manage Corporate – Users section of the website. Click Add User under this section and begin adding Users' information.

Our Company has corporate travel guidelines for employees when booking hotel reservations. Can I control what the users have the opportunity to book?
Yes, the Corporate Administrator has the ability to link and delink hotels by star rating and hotel location. The Corporate Administrator will also set a total maximum spending limit for each user.

My company uses a software program such as Cliqbook or Axiom to book transient stays. Can I still use hotels available from Active?
Yes, subject to review and approval from Active. If there are suitable hotels for your transient use, and Active has sufficient inventory agreements for your usage, we can request a corporate rate and id from the hotel so that you can book it through your software program. How are trade credits applied to purchases?
Trade Credits are automatically calculated and applied to each purchase per your corporate agreement with Active.

What if there is not enough trade credit to complete a purchase?
A purchase can not automatically be completed if your account has insufficient Trade Credit. Your travel request will be placed on request and a travel specialist will be in contact with you.

What type of reports will I be able to get?
The Corporate Administrator will have access to detailed usage reports on line to determine who traveled, dates of travel, rates and percentage of Trade Credits applied. This information can be found in the Manager Corporate Section of the website.
